Community Development

The mission of the Community Development Department is to enforce Foley Alabama’s motto of “…the Forward City…” by providing orderly and controlled growth for its citizenry combined with superior customer service in matters relating to development. We constantly strive to ensure that all codes, ordinances, and other regulations are met for the health, safety and well-being of all citizens.

The Community Development Department deals with day to day as well as long-range planning issues. We serve the Planning Commission, the Board of Adjustment and Appeals, the Mayor and City Council, the Construction Board of Adjustment and Appeals and the citizens of Foley.

Q.	How do I determine my zoning district?
A.	In order to determine a zoning district, confirmation of your location is needed - for example, a tax parcel identification number.

Q.	What is allowed in a particular zoning district? What am I allowed to build?
A.	The allowed uses vary depending on your zoning district. The Zoning Ordinance contains uses allowed, setbacks, area requirements and other information relating to the zoning district.

Q.	What size sign am I permitted to have?
A.	Signage is determined by zoning district, which is based on your physical location. The Zoning Ordinance contains Sign Regulations.

Q.	What is needed to subdivide my property?
A.	It varies based on the type of subdivision requested. The Subdivision Regulations contain information related to the process and requirements. Planning Commission applications and deadline schedules are available on the web site.

Q.	What will I need to obtain a permit?
A.	We offer a Contractors Package which lists items needed for processing the application; this may be downloaded from the website.

Q.	What will the permit cost be?
A.	The Inspections Department follows a pre-determined fee schedule. Please feel free to contact us for more information.

Q.	How long will it take to process the application?
A.	The time frame varies according to complexity of the project; you will be notified when the permit is ready and may be picked up.

Q.	How much time is needed to schedule an inspection?
A.	We prefer at least a 24-hour notice for scheduling inspections.

The Environmental Department resides within the Community Development Department. It is composed of the Environmental Manager and the Code Enforcement Officer. Complaints concerning environmental issues are managed through the code enforcement officer. These complaints include but are not limited to grass and weed nuisances, trash and debris nuisances, smoking, zoning, sign violations, heritage tree removal, and erosion and sediment control concerns. The department may also manage concerns regarding pollutants released into the air, land and water. This is typically accomplished through coordination with state and federal environmental agencies.

The Environmental Department coordinates several community enhancement programs, such as Community Cleanup Days and Annual Household Hazardous Waste Amnesty Day. The Department also administers several permitting programs. The Heritage Tree Removal Permit regulates the removal of all healthy, native trees with a trunk diameter over 30 inches. Shoreline construction activities such as bulkheads, piers, docks, boathouses (uninhabitable) and retaining walls require a Riparian Structure Permit for environmental impacts. The Erosion and Sediment Control Permit monitors impacts such as sediment tracking and sediment in stormwater runoff from construction activities. The department also reviews commercial and subdivision developments for environmental consistency with various regulations. The Environmental Department offers educational opportunities, presentations and speakers on environmental issues upon request.

Q.	When does the city hold a household hazardous waste amnesty day? How do I dispose of household hazardous waste?
A.	The City will hold the amnesty day annually in February. Latex paint may be disposed by allowing liquid to evaporate or adding absorbent (cat litter) and then placing the solids and container in the waste container. The Baldwin County Magnolia Landfill receives household hazardous waste daily at 15140 County Road 49.

Geographic Information Systems
The GIS Department is a division of the Community Development Department, but it provides mapping services throughout the city. The department is responsible for maintaining computerized data that depicts the current city limits, zoning districts and voter’s districts, all of which is available to the public on the City of Foley GIS Portal. We also work in conjunction with e911 and other county level departments to ensure the most current data is available to aid in emergency response situations to help ensure the safety of Foley’s citizens.

The Foley Historical Commission was established to oversee the Local Historic District. In 2005 downtown properties were listed on the National Register of Historic Places. With the listings came a need for a commission to oversee the district. The Local Historical District was officially formed by Council in 2008. The duties of the Commission include approving changes to the façade of buildings within the district and recommending additional properties that demonstrate historical significance to the City Council for inclusion. The Commission meets on the second Tuesday of every month to consider applications. If your building is located within the Historic District and you need to make a change to the exterior, please fill out the Application for a Certificate of Appropriateness below and return it to City Hall. Staff is available to answer any question you might have. Certain routine maintenance and other improvements may be approved by staff. Other more involved changes will be considered at a regularly scheduled meeting of the Foley Historical Commission.
